DISCLAIMER
Effective Upon Engagement Of Services
Using and/or utilizing the services of Keefe Private Investigations & Process Serving (“Keefe PI”), otherwise defined as process serving, private investigations, polygraph examination, notary public notary, nationwide skip tracing, document recovery, and nationwide criminal background reports, the Client, herein referred to as the Client herein additionally acknowledges and agrees to these terms and conditions. Making such a request or using a service involving you is considered a legally binding agreement to observe such provisions.
Service Fees & Payment Policy
We do not charge fees on results or outcomes provided; we charge on requested services. You are under obligation to foot all the bills that will be incurred, regardless of whether the effort results in the desired result, inconclusive results, or no information. Fees are based on the time, expertise, logistical resources, and overhead required to do the job.
We (and/or our affiliated licensees) may control our prices due to complexity, urgency, geography scope, and additional case-specific aspects. Estimates of fees required when giving quotes are not fixed and may vary in case of material changes in the nature or amount of work to be done compared with the original scope.
All invoices are due upon receipt. Work stoppage, late fees, or legal action can be imposed due to late payment, but that does not entail any limitation of other remedies that Keefe PI has availed.
Outcome Limitations & Data Accuracy
Although we are committed to professional and diligent service, you hereby understand and agree:

Results (finding persons, serving, and discovering documents) are not promised. The outcome depends on variables we can neither control nor influence (such as court schedules, third parties' cooperation, databases' completeness, and subject behaviors).

The records (records of parties, public searches, court records, private databases) could be delayed, wrong, or incomplete. We do not warrant comprehensive or error-free content.

When third-party technology, investigators, or platforms are involved, the work is dependent on those parties; we will not be liable for their errors or omissions.
Client Representations & Compliance
By requesting services, you represent and warrant:

You are authorized to demand the information or carry out the service, such as to serve papers or carry out background checks (e.g., in the case of a background check).

You cannot employ results to malicious, immoral, insulting, bigoted, bullying, and illegal activities.

You are legally and financially responsible for providing findings for use in litigation or regulation.

You promise to give accurate, complete, and legal instructions and information. Misinformation or erroneous information can lead to delay or failure of service and can lead to cancellation of service or extra payment.
Confidentiality & Professional Ethics
We will comply with the relevant state and federal privacy, licensing, and ethical standards. All information related to individuals and cases is confidential and can be disclosed only by designated individuals or according to legal procedure.
We are entitled to decline or withhold service in the following cases when requests:

Violate law or ethical standards.

Seek disallowed services (e.g., illegal surveillance, malicious defamation).

Put employees and third parties, or face the violation of professional ethics.

Involve conspicuous conflicts of interest.
Polygraph Examinations
Our polygraph is provided within the regulatory framework given by the Oklahoma state. You understand:
The polygraph's outcomes are not always admissible in a legal court or process. Tests are for investigative or informational use only. Keefe PI does not ensure their scientific accuracy and makes no reliability claims.
Notary Public Services
Keefe PI has notary publics who are commissioned by their state law and bonded when possible. Their solely authorized role is to:
We do not give a legal opinion, interpret written words, or make any statement as to the legal impact of any document.
Third-Party Vendors & Affiliates
We can cooperate with licensed investigators, background-check providers, couriers, or subcontractors. Although we screen partners, we do not bear any responsibility should these third parties make a mistake or fail to do anything. You also accept to exonerate Keefe PI against any claims that could emanate due to the actions of third parties relating to the services ordered by you.
Service Scope & Case Management
We offer a comprehensive range of services, including:

Process Serving across Oklahoma court jurisdictions.

Private Investigations: surveillance, cheating spouse/partner, fraud, missing persons, custody, insurance /worker-compensation fraud, cases of violent crime, prepping expert witnesses, etc.

Polygraph Examination by licensed examiners.

Notary Public Services: mobile or in-office notarization, apostille work, loan closings, affidavits, powers-of-attorney, copying, and faxing documents.

Skip Tracing Services nationwide.

Court Document Retrieval, Motor Vehicle Department Document Retrieval, and Document Retrieval state and Government or Private agencies.

Nationwide Criminal Background Investigations via licensed databases.
Other services could include restricted security surveillance or executive cover on a per-case basis.
Case Progression & Reporting
When a case is started, your designated investigator or process server will confer with you to clarify the scope, milestones, and frequency of non-emergency inquiries (daily, at milestones, or at case conclusion). We keep clean records and can provide affidavits or sworn statements, photographic or video records, and written narrative reports as routine output.
Service Termination & Refusal Rights
Keefe PI supports the special right to denounce any engagement in the event of:

The work becomes legally or ethically objectionable.

Client instructions are illegal or deceptive.

Staff or third-party safety is compromised.
-
Funding is withdrawn.
-
Continued pursuit offends policy, law, or our ethical code.
Keefe PI is not liable for them except for an agreement to refund unearned, pre-paid fees for services not performed.
Legal Compliance
The routine activities are performed in accordance with the laws of the United States of America and the state of Oklahoma on the matters of the activities of a privacy investigation, rights of privacy, proceedings in courts, applying polygraph, notarization, public records, and the requirements of criminal background. Trespass, wiretapping, hacking, and other crimes are not supported or practiced. It is upon the clients to ascertain that the findings contained in the report, especially in a litigation or employment process, are used legally.
Limitation Of Liability
Keefe PI will only be liable to any damages known to have been caused by the negligence, breach of contract, or under any other legal theory as limited by the sum you shall have paid regarding the specific service at hand except where the law mandates otherwise. Keefe PI will not be responsible under any circumstances for indirect, special, punitive,, or consequential damages (including but not limited to lost opportunity and attorney fees).
Disclaimer Of Warranties
All services are offered on an as-is and as-available basis with no warranties of any kind, express or implied, except the warranties of merchantability and fitness for a particular purpose or infringement. Database accuracy and reliability are not warranted by our professional standards of practice.
Indemnification
You will hold harmless, indemnify, and defend, to the fullest extent permitted by the law, Keefe PI, as well as its agents, employees, and affiliates against any damage, claims, liabilities, or expenses (including reasonable attorney fees) that occur through utilization of our services, your breach of this agreement, or the law.
Governing Law & Dispute Resolution
This contract is to be covered under the laws of the State of Oklahoma. Any dispute is to be resolved in the Oklahoma County courts only. You will have no right to trial by jury, and the point of venue shall be in Oklahoma County, Oklahoma.
Entire Agreement
This disclaimer and any accompanying engagement letter or rate sheet are between you and Keefe PI. It supersedes any prior discussions or representations. Amendments have to be written and signed by a representative of Keefe PI.

By engaging our services, you certify that:

The services shall not be executed until this disclaimer is known and accepted by signature or other written agreement.
